This Agreement is made between Jennifer Cirillo-Giammarco/ Wind Song Farm (Trainer) and (Owner),

Trainer agrees to board and train said horse beginning _____________________, 2008 on a month-to-month basis. Included in the fee above is hay,
grain, daily cleaning of stall, training time (no less than1 HOUR daily/ 6 days per week), and regular Am or PM turn-out time. Right of Lien: Trainer has
the right of lien as set forth in the law of the State of Florida for the amount due for the board and training and shall have the right, without process of law,

_____________________________________________________________________________ Standard of Care Trainer agrees to provide normal and reasonable care to maintain the health and well-being of said horse. Care and services NOT included in the fee are: Farrier services, de-worming, vaccinations, fly-repellant. Emergency Care If emergency treatment is needed, Trainer will attempt to contact Owner but, in the event Owner is not reached, Trainer has the authority to secure emergency veterinary and/or farrier care. Owner is responsible to pay all costs relating to this care. Trainer is authorized as Owner's agent to arrange billing to Owner. Risk of Loss While the horse is boarded at WindSong Farm, Trainer shall not be liable for any injury, sickness, death or theft suffered by the horse of any other cause of action arising from or connecting to the boarding of the horse. Owner fully understands that Trainer does not carry any insurance for any horses not owned by her for boarding or for any other purposes, for which the horses are covered under any public liability, accidental injury, theft, or equine mortality insurance; all risks are assumed by Owner. Owner agrees to hold Trainer harmless from any loss or injury to said horse. All costs, no matter how catastrophic, connected with boarding, training, or for any other reason for which the horse in on the premises of Trainer, are to be borne by Owner. Hold Harmless Owner agrees to hold Trainer harmless from any claim resulting from damage or injury caused by said horse and agrees to pay legal fees incurred by Trainer in defense of a claim resulting from damage by said horse. Termination Either party may terminate this Agreement given thirty (30) days notice to the other. In the event of a default, the wronged party has the right to recover reasonable attorneys' fees and court costs resulting from this failure of either party to meet a material term of this Agreement.

"Board Fee" subject to the following terms and conditions:
1. WINDSONG FARM agrees to maintain the Horse in the following manner:
A, Your horse will be coonsidered considered as such under FULL board at $550/monthly rate
B. Wind Song Farm is to clean the Horse's stall six days per week. (WINDSONG FARM will NOT CLEAN STALLS ON SUNDAYS)
C. FEED Wind Song Farm will supply _________________________________HAY Three times daily and _______________________ GRAIN IN AM and PM, also to water as needed.
D. To turn the horse out to pasture seven days per week, pasture and weather and footing permitting, holidays excepted. WINDSONG FARM staff will determine turn out schedules.
2. All medical care, whether provided by veterinarian or WINDSONG FARM and all shoeing provided by the farrier shall be at the expense of the Owner-Agent. In case of major illness or injury, WINDSONG FARM will attempt to contact the Owner-Agent of the Horses at the telephone numbers contained in this agreement. WINDSONG FARM reserves the right to call a veterinarian if, at its sole discretion, such action as in the Horse's best interest, and to authorize such emergency treatment as the veterinarian advises.
3. The Horse shall be free from infections and contagious or transmissible diseases. The following documents are required: current negative coggins test certificate, veterinarians health certificate, and a health worming and immunization record. WINDSONG FARM reserves the right to terminate of is agreement within seven (7) days of arrival or execution of this agreement, whichever is earlier, if the above documents are not received.
4. WINDSONG FARM reserves the right to notify the Owner/Agent if otherwise undesirable for the boarding stable. In such case the Owner/Agent is responsible for removing the Horse from the premises within seven (7) days of such written notice and payment of all fees incurred during the Horse's period of board. After all fees have been paid, this agreement is terminated.
5. The undersigned agrees to hold harmless and indemnify WINDSONG FARM, its employees or agents, from any and all claims, suits, judgments, or any costs whatsoever including attorney's fees arising out of any bodily injury or property damage caused by the Horse to any person, horse, or property.
6. WINDSONG FARM expects to receive payments for boarding fees on a timely basis. If your account is over 10 days past due, we will assess your account a late charge of $25.00 and a charge of 1.5% per month (18% annual rate).
Board will not be pro-rated and there will be no refunds.
7. In the event that the Board Fee is not received within thirty (10) days of the due date, WINDSONG FARM reserves the right to suspend barn and riding privileges and restrict the Horse to its stall, except for exercise through the Stables program at the instructor' discretion. We may exercise a lien against the Horse for all unpaid boarding fees and other accrued charges including attorney's fees or the amount due. Removal of the Horse from the premises may not occur prior to all debts to WINDSONG FARM being satisfied in full.
8. Any change in the Board Fee shall not be effective with less than thirty (30) days notice.
9. The Owner/Agent agrees that WINDSONG FARM, its employees and agents, are not liable for the illness, accidental injury, or death occurring to the Horse by any cause whatsoever, except if caused by the willful and gross negligence to WINDSONG FARM, its employees or agents.
10. WINDSONG FARM is not responsible for any personal property. It is the responsibility of each Owner/Agent to secure personal property and to carry full insurance including coverage on the Horse and all personal property.
11. If at any time an Owner/Agent or authorized rider of the Owner/Agent is determined by WINDSONG FARM at its sole discretion, to be undesirable by reason of behavior, poor horsemanship, or a record of untimely payment, WINDSONG FARM reserves the right to terminate this agreement with seven (7) days written notice to the Owner/Agent. All debts to WINDSONG FARM shall be satisfied prior to removal of the Horse from the premises and termination of the agreement.
12. ***HORSE OWNER IS RESPONSIBLE TO BUY/PAY FOR ALL MATERIAL NECESSARY FOR REPAIRS IF THEIR HORSE CAUSES ANY DAMAGE TO PROPERTY INCLUDING: BARN, FENCES, GATES ETC. AT WINDSONG FARM. THE DAMAGE MUST BE REPLACED WITHIN 24HRS OF DESTRUCTION IF INCIDENT OCCURS IN ORDER TO MAINTAIN SAFETY OF PROPERTY.
13. In the event of potentially disastrous weather i.e. hurricanes Horse Owner/Agent is solely responsible for their animal! We require owner to supply nametags on halter and braided into the tail of horse. If there is a mandatory evacuation each horse owner will be responsible for moving their horse or if unable to leave the Farm it is solely the owners responsibility to care for their animal(s)! We will NOT be held responsible for injuries to animals left behind.
